CONDITIONS OF ENGAGEMENT AGENCY WORKERS
Relief Professionals Terms of business for the supply of temporary staff. These are the conditions on which you accept the services of Members supplied by the Company as agent.
You will be charged for work undertaken by the Member. These charges shall consist of the amount payable to or on behalf o the Member, our commission and any expenses reimbursed all of which have been notified to you in advance, VAT on the commission and where appropriate an amount in respect of Employer’s National Insurance Contributions shall also be charged.
All charges are subject to regular review and variations will be notified to you in writing from time to time. All charges must be paid to the Company including the Member’s pay element which must not be paid to the Member direct. Although Members are self employed, the company is required by the Inland Revenue and the Department of Social Security to deduct tax and National insurance where appropriate and is responsible for paying those elements to the collector of Taxes.
2. Permanent Recruitment
If you employ the member within twelve months of the date the member was introduced to you by the company or of the date the member last attended you then the company shall be entitled to a Transfer Fee this one off fee will be charged in consideration of the introduction.
Whether the approach for employment is made by you, or a third party on your behalf, or by the Member. If you wish to employ a Member other than through the Company, Please contact the Local Company office to confirm the fee which normally is 15% of the Member’s expected earnings for the first year.
It is in your interest to ensure that a Company time sheet is signed for each assignment. Failure on your part to countersign the time sheet will not affect your liability for payment. The time sheet acts as record of the amount of time worked, upon which the charge to you is based, and is
final and binding in any event, whether countersigned by you or not.
4. Accommodation and Meals
You are required to provide meals for Members on residential duties and adequate facilities to rest or sleep for Members on sleeper duties. You may not deduct the cost of meals or any type of benefit in kind for a Member from the Company invoice.
Payment is required immediately on receipt of our invoices the Company will have paid the Member by the time you receive the bill, the Company reserves the right to require a deposit in an amount to be agreed as security against final payment.
6. Penalties for late payment
If no payment is received within 14 days after the date of invoice, and unless the Company has specifically agreed different terms a 10% surcharge will be levied on the invoice.
7. Invoice Queries
If you have a query on your invoice this should be reported to the Company immediately or within your specified payment terms. If an invoice is not queried within the timescales as mentioned in Condition 6, or your specified payment terms, the Company shall assume you accept the charges as being correct and the invoice will be due for payment in full.
8. Amendments to Bookings / Cancellation
If you wish to reduce, cancel or amend the booked services of the Member, you must give the Company at least 3 days notice. Failure to do so will result in a cancellation fee being charged to you. If a Member leaves an assignment prematurely or fails to attend, please telephone the Company branch immediately.
9. Insurance Claims
Nursing and other care may be covered by a client’s or patient’s private medical insurance. Except where the insurance policy specifically means the Company as a supplier in its conditions, the insurance claim must be made independently of our charges and you remain responsible for payment to the Company immediately you receive the invoice. If the Company is so named, the Company will against written instruction from the insurance company (but not before) invoice the insurers direct.
10. Equal opportunities.

You must ensure that at all times you comply with the provision of applicable statutory rules and regulation including Health and safety Regulations, the working Time Directive and Part Time Workers Regulations.
